Competition Rules
Below are the rules that apply to each skill-based competition that will take place on the Zuda website, currently found at www.zudacomics.com ("the Website"), that is owned, operated and maintained by or for DC Comics ("Zuda"). All terms defined in the Submission Agreement will have the same meanings when used herein.
1. NO PURCHASE NECESSARY TO ENTER. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
2. Each Competition will begin on the first Monday of the month at the moment when the competing Submissions are made available through the "Current Competitors" section of the Competition page of the Website, and will continue until mid-day of the last business day of the month (for example, the Competition for December 2007 begins on Monday, December 3, 2007 and ends on Monday, December 31, 2007 at approximately noon).
3. Entrants must be at least 18 years of age at the time of entry. Employees of DC Comics are not eligible for any Competition. Each entrant agrees to be bound by these Competition Rules and by the interpretations of these Competition Rules by Zuda, and by the decisions of Zuda, which are final in all matters relating to the Competitions.
4. To enter, you must register on the Website and submit your Submission in accordance with all of the terms and conditions of the Submission Agreement. During registration and submission, you will also be asked to acknowledge and agree to the Privacy Policy and Terms of Use.
5. Zuda will choose the competing Submissions for each Competition from the pool of Submissions received through the Website, and will make such competing Submissions available through the "Current Competitors" section of the Competition page of the Website. During the Competition period, any user of the Website can view the competing Submissions, and registered users can vote for their favorite. In addition, registered users can use other Website functionality for the competing Submissions as such functionality becomes available (for example, user ratings, views, comments and tags). The winning Submission in each Competition will be the Submission that has the most points at the end of the Competition under a points system which incorporates a certain number of points for each vote and additional points for other user activity as functionality becomes available.
6. Zuda will announce the winner on the Website and will contact the winner directly. Zuda reserves the right to disqualify what it believes to be fraudulent or disruptive votes or other user activity, to use technical and manual methods (including IP addresses) to monitor and enforce this policy, and to make all such judgments in its sole discretion.
7. The winner will be entitled to an online publishing deal on the exact terms and conditions set forth in the Rights Agreement and Services Agreement. If such person is, for any reason, determined by Zuda to be ineligible, then Zuda will have the right to rescind the deal offer and select the runner up as an alternate winner. No prize transfer, assignment or substitution by winners is permitted. If a prize is unavailable (for example, Zuda is no longer operating the Website), Zuda may, in its discretion, substitute the prize with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law.
8. Noncompliance with any of these Competition Rules may result in disqualification of a competing Submission. If a Competition is not capable of running as planned, for any reason, including due to a Website malfunction, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical or system failures, or any other causes beyond the control of Zuda which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition or for any reason Zuda deems it necessary, Zuda may cancel, terminate, modify or suspend the Competition. Zuda is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email submissions to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to your computer related to or resulting from participation in a Competition.
The contents of the Site, including all Site software, design, text, images, photographs, illustrations, audio and video material, artwork, graphic material, databases, proprietary information and all copyrightable or otherwise legally protectible elements of the Site, including the selection, sequence and 'look and feel' and arrangement of items, and all trademarks, service marks and trade names (individually and/or collectively, "Material"), as between you and DC, are the property of DC and are legally protected under U.S. Federal and State laws, as well as applicable foreign laws, regulations and treaties.
9. Each Competition will be governed by, construed and enforced in accordance with the laws of the State of New York. The state and federal courts of the State of New York located in New York County will have exclusive jurisdiction over any case or controversy arising under a Competition.
10. Each Competition is sponsored by Zuda. Occasionally, another entity may sponsor a Competition, and such entity will be listed as a sponsor on the applicable "Current Competitors" page of the Website.
